correct me if im wrong but the park can use the name intimidator w/o using the likeness of that earnhardt fella...he doesnt own the word "intimidator"...
"Intimidator" is not trademarked, however "The Imtimidator" is by Teresa Earnhardt(See following link). Do I know if the use of "The Imtimidator" compared to "Imtimidator" changes anything, nope, I don't. However, I am sure someone on the boards does. I will say this, Paramount Parks has trademarked "The Hurler" and "Hurler" so I assume that there is difference. Furthermore, there is two other trademarks for "The Intimidator". It may even come down to the use of the trademark. Anyone know trademark laws, cause I only know basics if that much.
